On 28 February 2024, the panel of judges of the Judicial Chamber for Criminal Cases of the Kyiv Court of Appeal considered the appeal of the prosecutor of the Prosecutor General’s Office filed against the decision of the Irpin Town Court of Kyiv Oblast of 02 November 2023, which returned to the prosecutor the indictment in criminal proceedings on charges of a serviceman of the armed forces of the russian federation K. of committing an offence under Part 2 of Article 28, Part 2 of Article 438 of the Criminal Code of Ukraine to eliminate the deficiencies and bring it in line with the requirements of the Criminal Procedure Code of Ukraine within a reasonable time that will be objectively sufficient to eliminate these deficiencies.

As a result of the appellate review, the appeal of the prosecutor of the Prosecutor General’s Office was upheld, the decision of the Irpin City Court of Kyiv Region of 02 November 2023 on the charges of a serviceman of the russian federation armed forces K. was cancelled and a new trial was ordered in the court of first instance.
